Search the strongest identifier first

Use the exact license number when available. If you search by company, use the legal/licensed name and try removing unnecessary punctuation if no result appears.

Match the government record to the contract

Compare the licensed business with the business on the bid, contract, invoice and payment instructions. Ask for a written explanation before proceeding if different entities appear.

Read status, expiration and classification

Confirm the license is current and that the classification covers the work. A valid license in an unrelated classification is not enough.

Apply the current project threshold

For covered work, use the whole-project value: $5,000 or more residential and $25,000 or more commercial. Do not use the old $2,500 threshold.

Check the license number on the bid, contract and jobsite

Current law requires contractor license information in contracting advertisements and executed contracts, and the current rule requires jobsite license availability. The current 28 CSR 2 rule also states that a bid may not be accepted without the contractor’s license number on the face of the bid.

Check specialty workers and the project permit

If electrical, plumbing or HVAC work is included, verify the applicable individual trade credential. Then check the permit with the city/county authority serving the property.

Full-time employee

Current 28 CSR 2 defines a qualifying full-time employee as an employee who works at least 30 hours per week under the contractor’s control and supervision for wages and required benefits.

If the qualifier leaves

Current 28 CSR 2 generally requires an entity to name a replacement qualifier within 45 calendar days after notice that the qualifier has severed the relationship, subject to the rule’s exceptions.

Can one employee qualify multiple companies?

Current rule restricts a full-time employee from using the same passing examination score to qualify an additional entity as a full-time employee. Do not build a licensing arrangement around an informal rented qualifier.

The current bulletin lists the Contractor Licensing Act Exam as the business/law component required in addition to applicable trade/classification examinations. The current bulletin describes it as a 90-question examination with a three-hour period.

Failed exam

Current ProV guidance states that a failed examination may be retaken as often as necessary, with no waiting period between attempts; the candidate schedules the next available session and pays the exam fee again.

Reference-book trap

The current 2026 bulletin warns candidates that older books allowed under the state’s testing vendor before September 2024 are no longer automatically permitted. Use the exact current reference list for the examination.
Out-of-state route

Reciprocity, Universal Licensing and Conditional Bid-Only Licensing

Reciprocity

Current §30-42-18 permits the Board to recognize an equivalent classification without the ordinary written examination when the reciprocal-state and qualification requirements are satisfied.

Your home-state license does not automatically authorize WV work.

Universal Licensing Act

Current 28 CSR 2 provides that an applicant qualifying under West Virginia’s Universal Licensing Act passes only the West Virginia business/law examination under the contractor rule, while still having to establish eligibility under the separate universal-recognition statute.

Conditional license for bidding only

New 2026 law

New 2026 West Virginia Contractor License Transfer Rules for Immediate Family

Senate Bill 553 became effective June 12, 2026 and amended §30-42-7 to add an immediate-family transfer process.

Who counts as immediate family?

The current statute defines immediate family for this transfer provision as a:

  • Spouse
  • Child
  • Sibling
  • Parent

One-year exam window

Under the new statute, a qualifying immediate-family transferee can receive a one-year transfer under the statutory conditions, but generally must successfully complete whatever examination the Board requires within one year to maintain the license longer.

The statute also contains special provisions following the original license holder’s death or permanent incapacity and conditions tied to management/operation of the business or use of another qualified person.

Do not treat a contractor license as freely inheritable property. Use the specific §30-42-7 transfer procedure and contact WVCLB before changing ownership, management or license-holder relationships.

For covered public-improvement contracts entered into under the applicable statute where total work by contractors/subcontractors exceeds $50,000, current §21-3-22 imposes a construction-safety training requirement for workers assigned to the public-improvement worksite.

The statute generally requires successful completion of the OSHA 10-hour construction safety program no later than 21 calendar days after the person is employed at or assigned to the covered public-improvement worksite.

A state contractor license does not eliminate lawful local business registration, B&O tax, permits, zoning or inspection requirements. How to File a Useful West Virginia Contractor Licensing Complaint

Current procedural rule effective June 7, 2026 states that a person alleging a violation of the Contractor Licensing Act or Board rules may file a complaint with the Board. The Board provides a complaint form on its website, but the rule also permits another written form containing the required information.

Residential defect dispute

West Virginia’s 90-Day Residential Construction Defect Notice

Chapter 21, Article 11A is a separate residential construction-defect law. It should not be confused with the repealed contractor licensing provisions formerly found elsewhere in Chapter 21.
